KAIMERIE™ TERMS & CONDITIONS
Effective Date: August 8, 2026. These Terms & Conditions govern access to and use of the Kaimerie educational platform, website, applications, curriculum, tools, and related services.
Welcome to Kaimerie
Kaimerie is owned and operated by FOR HER MEDIA LLC, a Texas limited liability company. Kaimerie is a platform of No Average Student, an education brand of FOR HER MEDIA LLC. By accessing or using Kaimerie, you agree to these Terms. If you are a parent, legal guardian, educator, school, organization, or other authorized adult creating or approving access for a student, you agree to these Terms on your own behalf and, where legally permitted, on behalf of the student.
1. Purpose of Kaimerie
Kaimerie is an educational platform designed to help students develop academic, research, writing, organizational, college and career readiness, and related skills. The Platform may include lessons, assignments, research activities, assessments, reflections, achievements, progress tracking, portfolios, teacher or instructor feedback, and other educational resources. Kaimerie supplements educational instruction and does not guarantee any particular academic outcome, grade, admission decision, scholarship, test score, or other result.
2. Student Accounts
- Student accounts may be created or authorized by a parent or legal guardian.
- A school, educational organization, or authorized educator may also create or authorize accounts.
- The student may create an account when permitted by applicable law and the Platform’s account requirements.
- Users must provide accurate information and maintain the confidentiality of their login credentials.
- Users may not share accounts, impersonate another person, access another user’s account without authorization, or attempt to circumvent Platform security.
3. Students Under 13
Kaimerie may be used by students under the age of 13. When applicable, Kaimerie will obtain verifiable parental consent before collecting personal information directly from a child under 13 as required by the Children’s Online Privacy Protection Act (“COPPA”). When Kaimerie is used through a school or educational organization, the school may, where legally permitted, provide authorization or consent for the collection of student information for educational purposes on behalf of parents. Kaimerie will use information collected from children under 13 only as reasonably necessary to provide the educational services or as otherwise disclosed in the Kaimerie Privacy Policy and permitted by law.
4. School and Organization Accounts
Schools and organizations may license or provide Kaimerie to students, educators, administrators, and families. The school or organization is responsible for determining which individuals are authorized to access its Kaimerie environment and for providing any notices or obtaining any permissions or consents required of the school by applicable law. When a school provides Kaimerie with information from student education records, Kaimerie will use that information only to provide the contracted educational services, fulfill authorized educational purposes, maintain and improve the Platform as legally permitted, comply with applicable law, and protect the security and integrity of the Platform. Additional contractual terms, including a school services agreement or data privacy agreement, may apply to institutional customers.
5. Student Work and Portfolios
Students may create and store assignments, research, reflections, projects, portfolio materials, and other original work through Kaimerie (“Student Content”). Students retain ownership of their original Student Content. Neither Kaimerie nor FOR HER MEDIA LLC claims ownership of a student’s original academic work merely because it is created, submitted, or stored through the Platform. The student and, where applicable, the student’s parent, guardian, school, or organization grants Kaimerie a limited right to host, store, process, reproduce, display, and transmit Student Content only as reasonably necessary to operate the Platform and provide its educational services. Kaimerie may provide tools that allow students or authorized users to download or export portfolio materials.
6. Educational Records
Some information maintained through Kaimerie may constitute an education record when Kaimerie is providing services to a school or educational institution subject to the Family Educational Rights and Privacy Act (“FERPA”). Where applicable, Kaimerie will handle education-record information in accordance with its agreement with the educational institution and applicable law. Kaimerie will not use personally identifiable information obtained from education records for unauthorized purposes.
7. Acceptable Use
Users agree to use Kaimerie for legitimate educational purposes. Users may not:
- bully, threaten, harass, or intimidate another person;
- upload unlawful, harmful, discriminatory, obscene, or abusive content;
- upload malware or malicious code;
- attempt to gain unauthorized access to accounts, systems, or data;
- interfere with Platform security or operation;
- copy or distribute Kaimerie’s proprietary curriculum without permission;
- use automated systems to scrape or extract Platform content or user information;
- misrepresent another person’s work as their own; or
- use the Platform in violation of applicable law or school policies.
Kaimerie may restrict or suspend access when necessary to protect students, users, the Platform, or others.
8. Academic Integrity
Kaimerie is designed to support learning. Students are expected to submit their own work unless collaboration, outside assistance, or use of particular tools has been authorized by their instructor. Kaimerie may provide tools or educational guidance related to research, writing, technology, and responsible use of artificial intelligence. Students remain responsible for complying with the academic-integrity requirements established by their school, instructor, or program.
9. Intellectual Property
Kaimerie’s curriculum, lesson structures, instructional materials, graphics, branding, software, Platform design, trademarks, and other proprietary materials are owned by or licensed to FOR HER MEDIA LLC and are protected by applicable intellectual-property laws. A Kaimerie subscription or institutional license grants users a limited, nonexclusive, nontransferable right to use those materials for authorized educational purposes. Except where expressly authorized, users may not reproduce, sell, sublicense, publicly distribute, publish, or create commercial derivative products from Kaimerie’s proprietary materials. This section does not transfer ownership of Student Content to Kaimerie.
10. Parent, Teacher, and Administrator Access
Depending on the account type and services purchased, Kaimerie may allow authorized parents, teachers, counselors, instructors, or administrators to view student information, including assignments, progress, achievements, feedback, and portfolio materials. Access is limited to individuals authorized through the applicable account, school, organization, or program.
11. Third-Party Services
Kaimerie may use trusted service providers for services such as hosting, authentication, data storage, communications, analytics, security, and other functions necessary to operate the Platform. Third-party providers that receive personal information are expected to process that information only for authorized purposes and subject to applicable contractual and legal restrictions.
12. Privacy
Use of Kaimerie is also governed by the Kaimerie Privacy Policy. The Privacy Policy explains what information Kaimerie collects, how that information is used, when information may be disclosed, and the choices available to students, parents, schools, and other users.
13. No Sale of Student Personal Information
Kaimerie does not sell student personal information. Kaimerie does not use student personal information for targeted advertising based on a student’s activities across unrelated websites, applications, or services.
14. Account Suspension and Termination
Kaimerie may suspend or terminate access when a user:
- materially violates these Terms;
- creates a security or privacy risk;
- engages in fraudulent or unlawful activity;
- uses the Platform to harm another person; or
- loses authorization from the school, organization, parent, or account holder responsible for providing access.
Where appropriate, Kaimerie may provide notice and an opportunity to resolve the issue before terminating access.
15. Availability and Changes
We work to maintain reliable access to Kaimerie but cannot guarantee that the Platform will always be available without interruption. We may update, modify, add, or discontinue Platform features as the program develops. If a material change affects user privacy or contractual rights, we will provide notice when required by applicable law.
16. Disclaimer
Kaimerie provides educational resources and technology. To the fullest extent permitted by law, the Platform is provided on an “as available” basis. Kaimerie does not guarantee specific educational, academic, admissions, scholarship, employment, or career outcomes. Nothing in these Terms limits rights that cannot legally be waived.
17. Limitation of Liability
To the fullest extent permitted by applicable law, FOR HER MEDIA LLC will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from use of or inability to use the Platform. This limitation does not apply where liability cannot legally be limited or excluded.
18. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
19. Changes to These Terms
We may update these Terms as Kaimerie evolves or as legal requirements change. When material changes are made, we will update the effective date and provide additional notice when required by law.
